原出願２に記載された事項が、原出願１の明細書等に記載された事項の範囲内ではなく、原出願２は原出願１に対し分割要件を満たさない。したがって、仮に、請求項１から上記新規事項を削除したとしても、本願は原出願１のときにしたものとみなされない。
