請求項２には「シール装置、特にOリングの形態の、シール装置」と記載されているが、シール装置はOリングに特定されるのか否か明確でない。「特に」という表現からはシール装置は必ずしもOリングに特定されないことを示唆しているように解されるが、請求項２のその後の記載部分において、「前記Oリングが」と記載されており、シール装置はOリングに限定される形で記載されている。請求項２に係る発明は、シール装置がOリングでなければならないのかOリングでなくともよいのか明確でない。

It is understood that the phrase “in particular” suggests that the sealing device is not necessarily limited to an O ring. However, in the subsequent descriptive portion of claim 2, it is described that “the O ring seals…”, and accordingly, it is understood from this description that the sealing device is limited to an O ring. In the invention according to claim 2, it is unclear whether the sealing device must be an O ring or need not be an O ring.
解説
本問のように“in particular”という表現を使って例示であるかのように記載した構成要素がその後の記載では例示構成要素だけが引用されることは米国クレームではしばしば見られる。つまり、”in particular”は例示というよりはむしろ限定に近いことが多い。いずれにしろ、我が国においては上記のような拒絶理由が出される。
